Terms, Conditions and Privacy (Terms of Business)

1.1 Gift Vouchers
Gift vouchers must be presented at the start of your course. The instructor will retain the gift voucher. The vouchers are only to be used once. Failure to produce your gift voucher will result in your course being cancelled and all fees will be lost by the customer. A gift vouchers is a visual presentation of a previous transaction and is subject to the same conditions. In the event of a cancellation of a booking and where a gift voucher has been purchased the gift voucher may be kept by the customer to be used at a later date (if complying with the below statement). If a cancellation has taken place where a gift voucher has been used and notice complying with the below statement has not been given then the customer will be liable for the outstanding balance. A record will be kept and payment must be taken before re-booking a course. All purchases made through Uk Motorcycle Training will adhere to our Privacy Policy. 2.1 Cancellations, Rebookings, Refunds
It is a legal requirement that a valid UK license be presented on the morning of the course. All relevant paperwork must be present before the training course can be started. It falls to the student to ensure that this paperwork is available upon request. If the relevant paperwork cannot be provided by the student their course may be cancelled by the appointed instructor. If this is the case the student must rebook onto another course. No refund will be offered. If a student fails to attend their course without giving notice no refund will be offered.UK Motorcycle Training may cancel training courses if the weather does not allow safe completion of the course. If that is so notification will be given to the student as soon as possible before the start of the course. Any courses that are cancelled by UK Motorcycle Training Ltd due to bad weather can be rebooked at no extra charge. If you wish to rebook your course for any reason you must provide at least 7 days notice. Any re booking requests within 7 days from the date of the course are subject to a 50% booking fee. Cancellation of courses may be refunded in the form of future credit. This credit will be held against the name of the student until that student wishes to rebook or spend such credit on products and services available through UK Motorcycle Training Ltd or associated businesses that accept such credit. Any cancellations of courses must be given in writing. Rebookings and refunds in the form of credit are available for Full License courses less the fees paid in advance by UK Motorcycle Training Ltd for registration for DSA Test Slots. Cancellations and rebookings of Full License courses including all courses offering DSA Test Registration for candidates follow the same terms and conditions set out above but also adhere to the following statement. " DSA Test Registration Fees are non refundable by UK Motorcycle Training Ltd. These fees are set by the DSA and details of these are available upon request."
3.1 Deposits
All deposits placed for training courses are non refundable or transferable. Deposits left for Full License courses must be a minimum of £150.
4.1 Legal requirements
Uk Motorcycle Training Ltd is a DSA approved training centre. As such all activities carried out by UK Motorcycle Training Ltd are governed by the DSA. UK Motorcycle Training Ltd has an obligation to complete all training courses to the guidelines set out by the DSA. Part of that legal obligation is to ensure that all students meet the required legal standard. Students must have a valid UK license and it falls to the student to ensure this is the case before the booking of any courses.
5.1 Privacy
All information passed to UK Motorcycle Training Ltd will be treated as confidential. As such no information will be shared with any other company or organisation. Certain information that may be seen to be relevant for future liaison with customers may be kept on record. Uk Motorcycle Training Ltd may then use this information to distribute marketing material. If you do not wish your details be kept on any kind of record please make this known to the advisor you speak to. Private information such as credit card details will be disposed of once no longer of use. All data held meets the requirements set down in the Data Protection Act.
6.1 Offers and discounts
Uk Motorcycle Training Ltd will often advertise promotional offers for courses and services. These offers will be governed by terms and conditions specific to the offer. 7.1 Course Agreements
All instructors currently registered with UK Motorcycle Training Ltd are DSA Approved and have many years of riding experience. All students attending one of UK Motorcycle Training Ltd courses must agree to follow the instruction of the appointed registered instructor (within reason). Any students that fail to meet this vital requirement may have their course cancelled.
7.2 Course Agreements (Declaration of adequate training) Amended 29/04/10
As of the 01/06/2010 all students attending courses where “on-road” training is given must sign a “Declaration of adequate training” before the commencement of such training. This declaration will state that the trainee is satisfied with the level of training received so far and feels sufficiently competent to proceed with the completion of such training, has assessed the weather and feels safe to continue and considers the motorcycle to be of a suitable purpose for use. Failure to sign this declaration will result in the course being unable to continue. This clause has been bought in as part of a new structure to the Motorcycle Training Insurance Policy.
8.1 Complaints
Complaints must be made in writing to UK Motorcycle Training Ltd. If a resolution cannot be made between the customer and UK Motorcycle Training Ltd the complaint will be passed to the Driving Standards Agency. The DSA will then act as a mediator between the customer and UK Motorcycle Training Ltd.
9.1 Damage Clause
As of the 01/01/10 all students taking part in any training conducted on vehicles owned by UK Motorcycle Training Ltd will be held liable for any damage caused to such machines whilst under the control of the student. If the total cost to repair such damage is in excess of £1000 the student will be liable for the first £1000 of this repair. UK Motorcycle Training Ltd reserves the right to postpone courses until the cost for repair has been paid. “Light” Damage will be assessed by our in house mechanic and an invoice will be presented to the student. “Heavy” Damage will be assessed by a repair workshop and copies of the invoices will be forwarded to the student. By signing the Courses Agreement at the start of your course you agree to the above statement.
9.2 Damage Waiver
UK Motorcycle Training Ltd offers students the chance to void the “Damage Clause” in the form of a “Damage Waiver”. This in an optional charge payable either on booking or at any point before the start of the course. The Damage Waiver is a non refundable one-off payment of £20. Once paid the student will be exempt from any liability relating to cost of damage that may have been incurred through the duration of the course.
APP1 Postal Costs
Some goods purchased from UK Motorcycle Training Ltd will be posted to the customer. These posted items will be sent using Royal Mail Recorded Delivery and will require a signature. Goods will only be posted to the given address provided by the customer on purchase.
If a signature cannot be obtained on delivery the parcel will be returned to the local postal depot. After which the parcel will be returned to UK Motorcycle Training Ltd. Once these goods have been returned to UK Motorcycle Training Ltd further postal fees will need to be paid for the second delivery. |
